Fourth Session of the Intergovernmental Negotiating Committee for a Legally-Binding Agreement on Forests in Europe (INC-Forests4)

INC-Forests4 continued on Tuesday, 11 June. Contact group facilitator Christoph Dürr, Switzerland, presented a report on the group's work on the definition of forests, and on outstanding issues in the articles on principles, forest resources and their contribution to global carbon cycles, productive functions of forests, and monitoring and reporting. The INC agreed to proposed compromises concerning: the definition of forests; the relationship of the convention with other agreements; forest fragmentation; the use of wood from sustainably-managed forests; and references to criteria and indicators in guiding parties' reporting on the status of their forests and progress towards sustainable forest management (SFM).

Facilitator Stephen Lowe, UK, then reported that the Legal Expert Group's review of the draft annex on conciliation resulted only in one minor editorial change, but that at the request of one delegation, the entire annex was bracketed pending further reflection.

The INC-Forests Secretariat then introduced the Bureau's paper on: major cost elements likely to be associated with the convention; possible sources of financial resources; and proposed text on the financial provisions of the convention calling for the conference of the parties (COP) to adopt, by consensus at its first meeting, the financial rules and necessary financial arrangements for the purpose of implementing the convention. The INC agreed to add the Bureau’s proposal to the draft negotiating text and then held an initial discussion on finance, including whether there should be mandatory and/or voluntary contributions.

The INC also discussed the articles regarding the COP and the right to vote, as well as the outstanding issues in the articles on the secretariat and compliance. The outstanding issues on the COP, the secretariat and compliance were referred to a contact group to be convened in the evening. The INC reviewed outstanding issues in articles regarding the settlement of disputes, protocols, the depositary, signature, ratification, entry into force and withdrawal, but was not able to remove all brackets and reach agreement on final clauses. The INC did however agree to delete a reference in the convention to a possible annex on indicators.

In addition to the contact group on the COP, secretariat and compliance, an informal Chair's consultation was held seeking a compromise on hosting the convention.
